The Ministry of the Environment and Spatial Planning is competent for working with GMOs in premises, such as, for example, laboratories, greenhouses, industrial facilities and similar spaces. The Ministry of the Environment and Spatial Planning issues receipts of the entry of the premises for contained use and permits for working with GMOs in contained use in the register of GMOs.
Deliberate Release of GMOs into the Environment
For deliberate release of GMOs into the environment, the applicant must obtain the permit of the Ministry of the Environment and Spatial Planning. The latter must provide the information on notification to the European Commission and EU member states.
The Ministry of the Environment and Spatial Planning issues the permit in agreement of the Ministry of Agriculture, Forestry and Food.
Placing of GMOs as Products or in Products on the Market
For the first placement of the GMO on the market as a product or in a product, the applicant must obtain an authorization. The Ministry of the Environment and Spatial Planning must provide the information on notification to the European Commission and the EU member states. The decision on putting GMOs on the market as products or in a product is made at the EU level and is valid for the entire EU.
The Ministry of the Environment and Spatial Planning issues the authorisation with the agreement of the Ministry of Agriculture, Forestry and Food and the Ministry of Health.
For GMOs and products, to which the provisions of the Management of Genetically Modified Organisms Act (Official Gazette of the RS 23/2005) do not refer, the competencies are defined in the regulations, for which the Ministry of Agriculture, Forestry and Food and the Ministry of Health are competent.
